Is Kratom Legal in Texas 2020? Are You Breaking the Law?

If you live in Texas and have recently heard about kratom, you my be wondering wether kratom is legal in your state. Hi, my name is Philip, co-owner of Kratom Krush. Allow me to enlighten you on a few details regarding the legality of kratom in Texas and put your mind at ease for once and for all.

Long story short, kratom, also known as Mitragyna Speciosa, has been and still is legal in the state of Texas. Even though kratom is not approved by the FDA, Texas allows you to buy, carry, and consume kratom without the consequences of legal action. Therefore, allowing smoke shops and liquor stores to sell kratom.

Don’t let fear of the law stop you from obtaining all of kratom’s amazing medicinal benefits. If you use kratom, you are not committing a crime.

Kratom Legality in Texas

Although many states have outlawed kratom, Texas stands on it’s promise of freedom. The vast majority of states, 37 to be exact, have not banned kratom.

As of 2020, there is still no legislation to regulate the buying, carrying, or consumption of kratom. There are no Texan laws addressing kratom or its ingredients.

If a police officer were to detain you while under the possession of kratom, there’s a very good chance he or she would not be able to identify the plant. Your kratom may be confiscated, but after testing the substance it would be returned to you without any charges.

Texas’ high tolerance (pun very intended) to the legalization of kratom may be partly due to the its location. Texas is located on the southern border known for its high level of drug smuggling.

When you have highly addictive and dangerous drugs such as meth and heroine being smuggled through your state, a dry powder that helps people alleviate pain and anxiety may seem a bit less concerning.

Will Kratom Always be Legal in Texas?

Nothing is set in stone. However, judging by Texas’ legislation, it doesn’t seem like kratom will be banned any time soon. Texas is a state that highly values the freedom of its residents.

Furthermore, there doesn’t seem to be any opposing movements against kratom in Texas.

There is one factor that may push kratom towards being outlawed. In 2016 the DEA attempted to classify kratom as a schedule 1 substance. Had the DEA actually been successful, kratom would have been categorized with drugs such as meth and heroine.

Luckily, kratom fans organized and thwarted the DEA’s decision to re-classify kratom. There have not been any further attempts to outlaw kratom since.

Where in Texas Can You Buy Kratom?

Although kratom is legal in Texas, big corporations such as Wal Mart, Walgreens, or CVS do not sell kratom products. If I had to take a guess, I would say it’s probably because they more to lose than to gain. Federal Kratom laws can change from one day to the next and leave these massive companies with a myriad of inventory or even worse, legal issues.

Don’t lose hope just yet! You can still find kratom in any of the following locations.

  • Liquor Stores
  • Smoke Shops
  • Botanical Stores
  • Gas Stations
  • Online Vendors

Not all of the locations on the list will sell kratom. For example, some smoke shops may carry kratom while others won’t. You may want to give them a call before heading to the nearest smoke shop to ensure they have kratom in stock.

However, keep in mind brick and mortar stores will always offer higher prices than online vendors because they have to cover high rent payments and other overhead.

If you’re going to purchase kratom I would highly suggest online vendors. It’s much easier to compare prices and quality. You can also ask for lab results.

At Kratom Krush we offer only organic high quality kratom powder and capsules. Our products are lab tested to ensure they do not contain harmful ingredients such as heavy metals, salmonella, and Ecoli. Our kratom is also pesticide free!

Short answer is no. Once you enter a state that has outlawed kratom you must abide by its laws and regulations. If you fail to do so, you will be charged for the crime.

Due to the lack of federal legislation, I would highly advice against traveling with kratom. Security at airports are extremely attentive to any type of substances being transported on the airlines. You don’t want to end up on the wrong side of that equation.
